
VICIOUS BISCUIT REWARDS TERMS AND CONDITIONS

1. PROGRAM OVERVIEW
The VICIOUS BISCUIT REWARDS (“Program”) is a customer loyalty program operated by VB-IP Holding Company, LLC (“Company,” “we,” “us,” or “our”). By enrolling in the Program, or using the associated mobile application or ordering website (“App”), you (“you,” “your,” or “Member”) agree to be bound by these Terms and Conditions (“Terms”).
2. ELIGIBILITY AND ENROLLMENT
2.1 Eligibility Requirements
- You must be at least 18 years of age to participate in the Program
- You must be a legal resident of the United States
- You must possess the authority and capacity to create a binding legal obligation
- You must provide accurate and complete information during enrollment
- You may maintain only one Program account per person, which is not transferrable
- You must not be a person barred by law from participating in the Program
- Company reserves the right to verify eligibility at any time and deny or terminate membership at its sole discretion
2.2 Enrollment Process
- Enrollment requires creating an account through the App
- You must provide a valid email address, phone number, and date of birth
- Company may require additional verification information at its discretion
- Company reserves the right to reject any enrollment application without explanation
3. POINTS PROGRAM
3.1 Earning Points
- Points are earned on qualifying purchases at participating locations
- Points earning rates are determined by Company in its sole discretion and may change without notice
- Points are credited to your account within 48-72 hours of purchase
- No points are earned on taxes, tips, gift card purchases, or other excluded items as determined by Company
3.2 Point Expiration
- All points expire six (6) months from the date of earning
- Expired points cannot be restored under any circumstances
- Point expiration dates are not extended by additional purchases or account activity
- Company will not provide notice of pending point expirations
3.3 Point Redemption
- Points may be redeemed for rewards as specified in the App but subject to these Terms and Conditions
- Redemption values and available rewards are subject to change without notice
- Points have no cash value and cannot be transferred, sold, or bartered
- Company reserves the right to modify or discontinue rewards at any time
- The redemption of Points is subject to the discretion of the participating location entirely in their sole discretion
4. WEEKLY BISCUIT BENEFIT
4.1 Benefit Details
- Eligible Members receive one (1) free biscuit per week
- Benefit is valid Monday through Friday only
- Requires a dine-in purchase with a minimum amount that the Company may change at any time
- Subject to product availability at participating locations
4.2 Restrictions
- Benefit expires at the end of each week and does not carry over
- Benefit can be combined with other offers with dine-in purchase unless specifically stated
- Not available for delivery or third-party ordering platforms
- Company reserves the right to modify or discontinue this benefit at any time
5. BIRTHDAY REWARD
5.1 Benefit Details
- Eligible Members receive one (1) shareable food item of Company’s choice during their birthday period
- Reward is determined solely by Company and may vary by location and time
- Company reserves the right to change, modify, or cancel this benefit at any time without notice
5.2 Timing and Restrictions
- Reward is available beginning on your birthday and expires three (3) days after your birthday
- Reward cannot be redeemed before your actual birthday
- Can only be redeemed in person at participating locations with proof of birthday satisfactory to Company
- Cannot be combined with other offers or promotions
- Subject to availability and participating location discretion
6. INDIVIDUALIZED OFFERS
6.1 Offer Distribution
- Company may provide personalized offers and promotions throughout the year
- Offers are determined at Company’s sole discretion. Not all Members will receive the same offers or frequency of offers
6.2 Offer Terms
- Each offer contains specific terms, conditions, and expiration dates
- Offers cannot be transferred, sold, or combined unless specifically stated
- Company reserves the right to modify or cancel any offer at any time
7. MOBILE APPLICATION
7.1 App Usage Requirements
- Use of the App is a benefit of Program membership
- App must be used in accordance with its intended purpose as determined by Company
- Unauthorized use, modification, or circumvention of App features is prohibited
- Company reserves the right to disable App access for any Member at its discretion
7.2 Technical Requirements
- Members are responsible for maintaining compatible devices and internet connectivity
- Company is not responsible for technical issues that prevent App usage
- App features and functionality may change without notice
8. COMPANY DISCRETION AND RIGHTS
8.1 Program Administration
- Company has sole discretion in interpreting and administering these Terms
- Company may modify, suspend, or terminate the Program at any time without notice
- Company reserves the right to determine participating locations
- All Program benefits are subject to availability and Company discretion
8.2 Account Management
- Company may suspend or terminate Member accounts at any time for any reason
- Company reserves the right to forfeit points and benefits upon account termination
- Company may investigate suspected fraudulent or abusive activity
9. MEMBER OBLIGATIONS AND RESTRICTIONS
9.1 Prohibited Activities
- Creating multiple accounts or sharing account credentials
- Attempting to earn points or benefits through fraudulent means
- Using the Program for commercial purposes or resale
- Violating any applicable laws or regulations
9.2 Account Responsibility
- Members are responsible for maintaining account security
- Members must notify Company immediately of unauthorized account access
- Members are liable for all activity on their accounts
10. TERMINATION
10.1 Termination by Company
- Company may terminate Member accounts at any time, with or without cause, and without prior notice
- Upon termination, all points and unused benefits are forfeited
- Company has no obligation to provide compensation for forfeited benefits
10.2 Termination by Member
- Members may terminate their accounts by contacting customer service
- Termination results in immediate forfeiture of all points and benefits
11. LIMITATIONS AND DISCLAIMERS
11.1 Program Limitations
- Benefits are subject to availability and participating location discretion
- Company makes no guarantee regarding product availability or quality
- Program benefits have no cash value and cannot be refunded
- COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- Company does not warrant that the use or quality of the App or the Program will be uninterrupted, error-free, timely, secure or meet your requirements or expectations
11.2 Liability Limitations
- COMPANY’S LIABILITY IS LIMITED TO THE VALUE OF FORFEITED POINTS OR BENEFITS
- COMPANY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
- Members participate in the Program at their own risk
12. PRIVACY AND DATA COLLECTION
Company collects and uses Member information in accordance with its Privacy Policy, which is incorporated herein by reference. By participating in the Program, Members consent to such collection and use.
13. MODIFICATIONS TO TERMS
Company reserves the right to modify these Terms at any time without prior notice. Continued participation in the Program following any modifications constitutes acceptance of the revised Terms. Members are responsible for regularly reviewing these Terms.
14. GENERAL PROVISIONS
14.1 Governing Law These Terms are governed by the laws of South Carolina without regard to conflict of law principles.
14.2 Severability If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.3 Entire Agreement These Terms constitute the entire agreement between Company and Members regarding the Program.
14.4 Venue for Disputes Member consents to jurisdiction in the Court of Common Pleas in Charleston County, South Carolina to resolve any disputes arising under the Program. MEMBER WAIVES HIS/HER RIGHT TO JURY TRIAL
14.5 Mediation Member agrees to mediate disputes arising under the Program before a certified Circuit Court mediator in Charleston County, South Carolina prior to bringing suit to resolve a dispute. The parties shall equally share the cost of mediation.
